TERMS & CONDITIONS

Please read these terms and conditions carefully before the purchase of any service or product from Starr Power Designs. 

By accessing the website at Starr Power Designs, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. Payment of all invoices means you have read and acknowledged our terms, conditions and policies. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

Payment & Expenses:

Client must pay non-refundable deposit, if not full payment before all projects begin. All services under $100 must be paid in full and non-refundable. Starr Power Designs reserves the right to suspend work & with-hold delivering of any project documents until past due balances/late fees are paid. The client shall reimburse the designer, if they have any specific requests for additional stock photography, artwork, fonts and/or material needed for their project. All service/ sales are non-refundable unless specified in writing (via email) by designer. 

Client Communication:

We understand that text messages are a quick way to communicate issues and requests. However, email is our preferred method of contact. Please send all emails to hello@starrpowerdesigns.com or support@starrpowerdesigns.com. It is our goal to respond to all email requests within 24-48 business hours. If the 48 hours runs into a weekend then please expect a response on the next business day. Currently our hours of operations are Monday-Friday 10AM-6PM, Starr Power Designs is closed on all Federal holidays. 

Copyright & Credit:

Starr Power Designs agrees to create original work for the client, free of plagiarism. The Designer holds copyright of any work created during this project until final payment has been made and files have been handed over. Client then holds copyright of the work once all work is delivered. Once Client holds ownership of the copyright, the original work should not be altered in any way.

 

Starr Power Designs can use samples, photographs or screenshots of the work created under this agreement, for promotional purposes (such as our website/social media outlets) once the project has been made public. The following credit should be mentioned on all publicity/promotion of this project from Starr Power Designs. 

 

If for any reason(s) you opt to have us display your designs within our portfolio or make any announcements via social media there will be a fee of $50. The full amount should be paid with your deposit or with the remaining balance of your design project. If unpaid, you are granted the permission to allow us to showcase your designs on our portfolio(s). For websites, if you decide to keep our link within your footer, the text must be no smaller than 10pt & must be visible for viewers to see. Our link should not be removed unless our work is no longer showcased on your website. Should we discover that our link is no longer present, but our work still is - you will be charged a $50 credit removal fee, if invoice is not paid legal actions will follow suit. We do not require our credentials on business cards, branding templates, printed flyers, logos, web graphics (such as: web banners, motion graphics), labels, or other printed materials. Showcasing your projects within our portfolio is our way of bringing in new customers & free exposure for your brand.

Client Responsibilities:

Client will provide accurate, complete and timely information, materials and feedback to Starr Power Designs. Client will approve and proofread all final designs, copy, publicity proofs and test sites. Starr Power Designs will make all efforts to ensure that no information is misrepresented. However, client assumes all responsibility for content. Starr Power Designs is not responsible for any misspelling of content or any absent information that was not included in the email or documents. When proofs are sent to the client, the client is expected to take a careful look at any misspellings or missing information that they want to be corrected. It is assumed the the client has the permission or rights for any pictures, content or graphics they send for the designer to use in any project. Starr Power Designs is not liable for any content, graphics or images the client provides. 

Confidentiality:

Starr Power Designs acknowledges that they may have access to information which relates to the client’s products, creative works, marketing strategies, projects and other information. Designer agrees to protect the confidentiality of this information. All communication between the client & designer is strictly confidential. Anything discussed between the two (ideas, visions, email addresses, photos, financial information, login information, etc) will not be released to anyone.

Revisions & Alterations:

Client will be given no more than 3 of revisions at each stage of the design. If further revisions are requested, Starr Power Designs will bill the client at a flat rate of $25 per revision. Additional revisions may result in a delayed completion date. Revisions of any kind have at least a 24-72 hour window for completion unless more time is required from our designers. Client does not retain ownership of any unselected compositions, ideas or sketches unselected durning the project. The ownership will remain with Starr Power Designs and can be used at their discretion. 

Cancellation:

Both parties understand that Client or Designer may terminate the service at any time if, for any reason, the relationship is deemed unsatisfactory by either party. If the project is terminated before services has been fully fulfilled, Starr Power Designs will retain the non-refundable deposit. If the client decides to cancel the service after final approval is made, Starr Power Designs reserves the right to keep the full payment amount. 

Limitation of Liability:

Illness of self or children, injury, or other events beyond Starr Power Designs control, such as fire, hospitalization, theft, computer failure, and Acts of God may result in a delay of unpredictable length. Client agrees that they shall not hold the Starr Power Designs liable for any incidental or consequential damages that arise from the designer’s failure to perform any aspect of the project in a timely manner. 

 

In no event shall  Starr Power Designs or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials/ services (product/website launches/domain name renewals) on/to be completed by Starr Power Designs, even Starr Power Designs or a Starr Power Designs authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Delayed Payment + Information + Abandon Projects:

If a client reserves a spot by paying a deposit for a design, & fails to communicate in a reasonable amount of days (14), client's project will be canceled & a fee is applied to restart the project (an additional deposit). After 30 days, projects that are unpaid & does not have the required information to begin, projects will be voided. Client will not receive any refunds for delayed projects. Web design projects will not be booked nor started without photography (no cell phone pictures) and content . Failure to provide photography and content when booking a web design service, may void your project & no refund will be warranted for your deposit. Photography must be prepared PRIOR to booking your web design services.

Website Design + Hosting:

All websites created by Starr Power Designs are non-transferable and the website code will not be exportable at this time. Websites created by Starr Power Designs must be hosted on/ with our preferred servers/platform which we reserve the right not to disclose. This means that if you wish to no longer us our preferred platform then your website will not be transferred to your new platform. Also, Starr Power Designs is not obligated to set-up your website on any new platform you decide to use.  Notices will be sent out to clients if and when we decide to export website codes for clients to be able to upload to their preferred server. Some features may not work once code is exported and the website is no-longer hosted with our preferred platform server.

 

All websites created by Starr Power Designs currently must be hosted with unless designed on the WIX platform. All websites designed on the WIX platform are controlled by WIX servers and subject to their terms/conditions and hosting fees. Please see their terms and conditions if you'd like to move a website designed by Starr Power Designs on the WIX platform which may or may not be possible. Starr Power Designs is not responsible for transferring/migrating any website designs, functions or elements to any other website platform. All hosting fees and plans can be found on the Wix website https://www.wix.com/upgrade/website.

Third Party App Integration

When it comes to third party app integration on your Wix  website you may be required to contact Wix or the app developer directly. While I Starr Power Designs offer some support to certain (non-Wix) third party apps such as Instagram & Facebook, our support efforts are limited for all other app integration. 

Reproduction of Product: 

Starr Power Custom Graphic Design, LLC (Starr Power Designs) retains the right to reproduce the Project in any form for marketing, future publications, competitions or other promotional uses. Graphic Designer shall at no time reproduce the Project for use in commercial means or for-profit use. 

 

Service Recipient may not reproduce or otherwise use design mock-ups, drafts, sketches etc. created by designer during work on the Project but not included into the final version of the Project. Such artwork belongs solely to Graphic Designer who may use it at his own discretion.

Use License

Permission is granted to temporarily download one copy of the materials (information or software) on  www.starrpowerdesigns.com for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

 

modify or copy the materials;

 

use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

 

attempt to decompile or reverse engineer any software contained on Starr Power Designs;

 

remove any copyright or other proprietary notations from the materials; or

 

transfer the materials to another person or “mirror” the materials on any other server.

 

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Starr Power Designs at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

Disclaimer

The materials on  Starr Power Designs are provided on an ‘as is’ basis.  Starr Power Designs makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

 

The tagline "Building Healthy, Happy, Wealthy Brands" represents our mission and approach towards brand development. It encapsulates our commitment to fostering brand success through holistic and strategic design and marketing practices. Please note, however, that while we apply our expertise and tailored strategies to each brand's unique journey, outcomes may vary based on a multitude of factors beyond our control. Further,  Starr Power Designs does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

Accuracy of materials

The materials appearing on  Starr Power Designs could include technical, typographical, or photographic errors.  Waterfront Wall Street does not warrant that any of the materials on its website are accurate, complete or current Waterfront Wall Street may make changes to the materials contained on its website at any time without notice. However, Waterfront Wall Street does not make any commitment to update the materials.

Starr Power Designs has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Starr Power Designs of the site. Use of any such linked website is at the user’s own risk.
